Shieys Chepkosgei alias Hillary Kiprotich was arrested and arraigned before the Chief Magistrate’s Court in Eldoret for presenting a forged post-natal discharge summary and a notification of birth, purporting to be issued by Uasin Gishu County Hospital.
The athlete who was serving a period of inegibility, after he/she was sanctioned by the Sports Dispute Tribunal for testing positive for a prohibited substance, participated in a sporting event during his/her period of ineligibility which constitutes to an Anti-Doping Rule Violation (ADRV) as stipulated by the World Anti-Doping Code.
In his/her defence she presented the forged postnatal discharge summary and a notification of birth.
He/she alleged that he/she had been admitted at the said facility where he/she gave birth to a baby boy through a caesarean section and had not recovered and thus could not have travelled to participate in the sporting event.
ADAK’s Investigations and Intelligence Gathering Unit proceeded to conduct verification of those medical documents.
Uasin Gishu District Hospital confirmed that those medical documents had been forged and that the athlete had not been treated or seen at the said hospital.
This revelation led to the athlete’s arraignment before court. He/she was charged pursuant to section 345 as read with section 349 of the penal code and section 42 (1) paragraph (e) of the Anti-Doping Act.
He/she pleaded not guilty and was released on bail.
The case will be mentioned on 28th March 2022. ADAK shall continue prosecuting athletes and their Support Personnel found culpable of Anti-Doping Rule Violations (ADRVs) in line with the laid down legal framework.
We wish to reiterate that we will not relent in the fight against doping. This is a resolve which has received support from the Cabinet Secretary for Sports, Culture and Heritage and measures have been taken for a zero tolerance of the vice. Athletes are encouraged to participate in clean sports thus promoting integrity. Any athlete found to have violated the provisions of the Anti-Doping Act will be dealt with firmly. ADAK promises to root out this immoral culture through the criminal justice system
